Ratio Decidendi

The appellate court found that the appellants did not adduce any evidence to rebut the respondent's case, leaving the respondent's evidence on liability unchallenged. The trial court's finding of 100% liability against the appellants was therefore justified. However, on the issue of quantum, the appellate court held that the award of Ksh. 250,000 for soft tissue injuries was inordinately high compared to recent comparable cases. The court substituted the award with Ksh. 150,000, finding this amount more appropriate for the injuries suffered. Each party was ordered to bear its own costs for the appeal, while the respondent was awarded costs in the lower court.
