Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the parties had properly pleaded and established their legal capacities to sue and be sued in respect of the suit property.
  2. 2 Whether the trial court erred in proceeding with the hearing and determining the suit and counterclaim in the absence of clear legal standing of the parties.
  3. 3 Whether the judgment and orders of the trial court should be set aside and substituted with an order striking out both the plaintiff's claim and the defendant's counterclaim.

Ratio Decidendi

The appeal was allowed on the basis that neither party had properly pleaded or established their legal capacity to sue or be sued in relation to the suit property. The trial court erred in proceeding with the hearing and determination of both the claim and counterclaim without resolving the fundamental issue of capacity. The pleadings failed to disclose the necessary legal standing, rendering the entire proceedings a nullity. Accordingly, the High Court set aside the judgment and orders of the trial court and substituted them with an order striking out both the plaintiff's claim and the defendant's counterclaim, with no order as to costs.
