Ratio Decidendi

The Court found that the notices of appeal were filed within the period required by the rules and that, by operation of Rule 80, only the first notice was operative while subsequent notices served as addresses for service. The application to strike out the appeal was dismissed as the applicant failed to comply with the timelines under Rule 84. On the stay application, the Court held that the applicant had demonstrated that the appeal was arguable and that, absent a stay, the disputed land could be sold or otherwise dealt with, rendering the appeal nugatory if successful. The Court therefore granted a stay of execution of the ELC judgment pending determination of the appeal.
