The court found that the plaintiff failed to prove he was ever allotted the suit land, Eldoret Municipality Block 7/154. The evidence showed the plaintiff was allotted a different parcel, namely an unsurveyed residential plot B26, and not the suit land in dispute. The lease and certificate of lease held by the plaintiff were therefore obtained either by fraud, misrepresentation, or at the very least, unprocedurally. The court held that title acquired in such a manner is impeachable under Section 26(1) of the Land Registration Act and is not protected by Article 40(6) of the Constitution.
