The court found that although there was a stay of execution order in place, the applicant failed to extract and serve the formal order before the sale occurred. The respondents and the auctioneer could not be said to have violated an order they were not aware of. However, the court noted procedural irregularities in the advertisement and sale, particularly the failure to comply with the 15-day notice requirement under Order 22 Rule 58 of the Civil Procedure Rules. The auctioneer, against whom allegations of impropriety were made, was not a party to the application and did not respond to the allegations, which were therefore deemed uncontroverted.
