Ratio Decidendi

The Court found that while the Claimant's failure to date a debit voucher was a significant breach of the Bank's procedures and compromised the position of trust, the Respondent failed to follow the mandatory procedural requirements under Section 41 of the Employment Act, 2007. The Claimant was not given an adequate opportunity to be heard before termination. As a result, the termination was procedurally unfair, warranting compensation. However, the claims for terminal dues and leave pay were dismissed for lack of proof. The Court balanced the Claimant's long service with his misconduct and awarded six months' salary as compensation for unfair termination.
