The claim should have been filed and heard under the repealed Trade Disputes Act Cap 234, as outlined in Section 84 of the Labour Relations Act, Schedule 5. The claimant failed to clarify the substantive law relied upon. If the claim was based on the repealed Employment Act Cap 226, it was time-barred under the Limitation of Actions Act Cap 22.
