Procedural Posture

Miscellaneous Application / Ruling on Application to Transfer Suit From Magistrate's Court to the Environment and Land Court

  1. 1 Whether the Chief Magistrate's Court had jurisdiction to hear and determine the suit concerning title to and occupation of land.
  2. 2 Whether a suit filed in a court without jurisdiction can be transferred to the Environment and Land Court.
  3. 3 Whether the applicants' lack of legal representation when filing the suit justifies indulgence by the court.

Ratio Decidendi

The court held that the Chief Magistrate's Court did not have jurisdiction to hear and determine the suit concerning title to and occupation of land, as the Environment and Land Court had already been established and vested with exclusive jurisdiction over such matters at the time the suit was filed. The applicants' lack of legal representation and ignorance of the law could not cure the jurisdictional defect. The law applies uniformly to all litigants, and a suit filed in a court without jurisdiction cannot be transferred to a court with jurisdiction. The application to transfer the suit was therefore dismissed with costs.
