Therefore, upon compliance with the precondition, the applicant was entitled to bring a fresh application for extension of time to be heard on its merits. The single Judge (Tunoi, JA) erred in holding that he lacked jurisdiction to hear the application and in striking it out. The reference thus succeeded, the ruling of Tunoi, JA was set aside, and the applicant's application was to proceed to hearing before another single Judge.
