Ratio Decidendi

The court found that, pursuant to Gazette Notice No. 9243 of 5th August 2011 and section 32 of the Industrial Court Act 2011, jurisdiction to determine disputes relating to work injury benefits lies with magistrates of the rank of Senior Resident Magistrate and above. As such, the Industrial Court lacked jurisdiction to entertain the application for leave to file suit out of time for work-related injury. The proper forum for such an application is the magistrate's court, and the matter should be transferred accordingly.
