There was no credible evidence of contributory negligence by the deceased. However, the trial court erred in adopting a multiplicand of Kshs. 5,000 per month for loss of dependency without sufficient proof of the deceased's income. The High Court substituted the multiplicand with the statutory minimum wage of Kshs. 1,306 per month, applied a multiplier of 10 years and a dependency ratio of 2/3, resulting in a reduced award for loss of dependency.
