Ratio Decidendi

The Court found that the applicants satisfied both requirements for a stay of execution under Rule 5(2)(b): (1) the appeal was conceded by the respondent to be arguable, and (2) the respondent's means to refund the decretal sum were not demonstrated, especially as he had not been in gainful employment since the accident. The Court held that the applicants had established that the appeal would be rendered nugatory if stay was not granted. The motion for stay was therefore allowed, and the appeal was ordered to be fast-tracked for hearing.
