Procedural Posture

Civil Case / Judgment

  1. 1 Whether the sale of the suit property by public auction was fraudulent or illegal.
  2. 2 Whether the plaintiff had repaid the loan in full and was entitled to redemption of the property.
  3. 3 Whether the third defendant lawfully acquired title to the suit property.

Ratio Decidendi

The court found that the plaintiff had failed to prove repayment of the loan or any fraud in the conduct of the auction. The evidence from the defendants and their witnesses established that the auction was lawfully conducted, the third defendant was the highest bidder, and the transfer was properly effected. The plaintiff's repeated litigation to frustrate the realization of the security and his failure to act upon notice of the auction undermined his credibility. The court held that the statutory power of sale was properly exercised, the third defendant acquired good title, and the plaintiff, having refused to vacate after notice, became a trespasser liable for mesne profits.

Court Disposition

Plaintiff's suit dismissed with costs. Third defendant declared lawful owner and entitled to vacant possession. Plaintiff to pay mesne profits and costs.

Orders

  • Plaintiff's suit is dismissed with costs to the defendants.
  • Third defendant is declared the absolute and indefeasible proprietor of the suit property.
