Ratio Decidendi

The court found that the Plaintiffs are the registered proprietors of the suit properties and that there was no evidence of fraud or illegality in their acquisition of title. The decree extracted by the Defendant in 2001 was declared null and void by the Resident Magistrate, and no valid basis existed for the Defendant's registration as owner. The Defendant failed to prosecute his defence or provide evidence of fraud. The court therefore declared the Plaintiffs as the bona fide owners, ordered the cancellation of the Defendant's registration, and directed the Land Registrar to restore the Plaintiffs' names on the titles.
