Ratio Decidendi

The Court found that the Claimant was, in substance, an employee of the Respondent, as he was paid monthly and performed regular duties. Both parties admitted that salary was not paid from January 2011. However, the Court determined that before awarding compensation or salary arrears, it was necessary to establish the extent of the Claimant's incapacity through a medical examination as required by the Work Injury Benefits Act and the Occupational Safety and Health Act. The Court directed that the Claimant be examined by a doctor assigned by the Director of Occupational Safety and Health Services, and deferred the determination of compensation or arrears pending the medical report.
