The Plaintiff was the first registered and lawful proprietor of L.R. NO. 36/VII/260, having acquired the property through a valid conveyance in 1969. The City Council of Nairobi, lacking any valid proprietary interest, could not lawfully allocate or transfer the suit property to the 1st Defendant. The purported conveyance to the City Council in 1967 was not proved and, even if it existed, would have been ineffectual as the transferor had no interest to convey at that time.
