Procedural Posture

Land and Property Suit / Judgment

  1. 1 Whether the suit is statute barred under the Limitation of Actions Act.
  2. 2 Whether the Defendant's title to the suit land was obtained fraudulently.
  3. 3 Who should bear the costs of the suit.

Ratio Decidendi

The Plaintiff's claim is statute barred, as the cause of action arose in 1980 and the suit was filed 37 years later, well beyond the twelve-year limitation period for recovery of land and the three-year period for actions based on fraud. The Plaintiff failed to plead or prove particulars of fraud as required by law, and did not discharge the burden of proof. The Defendant's title, having been lawfully acquired and registered, is protected by the principle of indefeasibility of title. Consequently, the Plaintiff's case fails both on limitation and on the merits, and must be dismissed with costs to the Defendant.
