Ratio Decidendi

The court found that the applicant could not have applied for substitution before obtaining letters of administration ad litem, which were only granted on 9th July 2018. The delay in seeking substitution was therefore justified. The court further held that the cause of action survived the death of the plaintiff, rejecting the defendant's argument to the contrary as unsupported by law. The court exercised its discretion under Order 24 Rule 3(2) to extend the time for substitution and allowed the applicant to be substituted as plaintiff. Costs were ordered to be in the cause.
