The court found that the appellant had discharged his burden of proof by providing unchallenged evidence that his vehicle was hit from behind by the respondent's vehicle. The respondent failed to call her driver to provide an alternative explanation or substantiate the pleaded defence of sudden stopping. The trial magistrate's finding on liability was therefore erroneous in fact and law. On damages, the court held that since the vehicle was assessed as a total loss, the appellant was entitled to the pre-accident value less salvage value, in addition to the other heads of damages awarded by the trial court.
