Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the claimant's dismissal was fair under the Employment Act, 2007.
  2. 2 Whether the claimant is entitled to compensation for unfair dismissal, gratuity, leave, and notice pay.

Ratio Decidendi

The court found that the claimant was not given any notice of misconduct or a hearing prior to his termination, in violation of section 41 of the Employment Act, 2007. The respondent failed to establish the alleged misconduct as the basis for dismissal. Given the claimant’s long service and legitimate expectation of continued employment, the court determined that the dismissal was unfair. The court awarded the claimant twelve months’ gross pay as compensation, pro-rata leave pay, one month’s salary in lieu of notice, and gratuity for the last 27 months of service, as per the contractual terms.

Court Disposition

Judgment for the claimant; respondent to pay specified sums and costs.
