Procedural Posture

Criminal Revision / Ruling on Application for Revision of Sentence

  1. 1 Whether the High Court has jurisdiction to review or revise a sentence imposed by a court of concurrent jurisdiction.
  2. 2 Whether the applicant's mitigation and reformation are grounds for sentence revision in this context.

Ratio Decidendi

The High Court lacks jurisdiction to review or revise a sentence imposed by a court of concurrent jurisdiction, such as another High Court judge. The applicant's request for sentence revision is therefore not tenable, as the revisionary powers of the High Court are limited to proceedings from subordinate courts. The factors raised by the applicant, including reformation and mitigation, are only relevant in resentencing hearings, which is not the case here. The court must down its tools where it finds it has no jurisdiction, and thus the application is dismissed for want of jurisdiction.
