The application by the first respondent in that suit was, in substance, an objection to attachment under Order 22 of the Civil Procedure Rules. Section 34(1) of the Civil Procedure Act mandates that all questions relating to execution between parties to the suit must be determined by the executing court, not by a separate suit.
