The only grounds advanced for recusal were the judge's refusal to hear interlocutory applications and the dismissal of the suit for non-compliance with court directions, neither of which established bias under the objective test. The Court further noted that the judge in question was no longer sitting in Kisumu, and the applicant had not shown any prejudice that would result from the suit proceeding before other judges. The application was found to be without merit and was dismissed with costs.
