Legal Issues
- 1 Whether the appeal can be entertained when the lower court file and the appellant's particulars cannot be traced.
- 2 Whether the cited lower court case relates to the appellant and is valid for appeal.
Ratio Decidendi
The appeal was summarily rejected because the appellant provided incorrect particulars regarding the lower court case, and his name could not be traced in the Siaya Principal Magistrate's court records. The cited lower court file, Siaya PM Cr. SO 22/2019, pertained to a different accused and had already been withdrawn under Section 87(a) of the Criminal Procedure Code. As there was no valid conviction or sentence against the appellant in the referenced file, and no traceable record of the appellant's case, the High Court found no basis to entertain the appeal and ordered the file closed.
Court Disposition
appeal summarily rejected
Orders
- The appeal is summarily rejected as the particulars of the lower court file cannot be traced.
- The file is closed.
