Procedural Posture
Civil Case / Ruling on Application to Correct Decree
Legal Issues
- 1 Whether the High Court should correct a decree that is already the subject of an appeal.
- 2 Whether the application to correct the decree is properly before the court.
Ratio Decidendi
The High Court declined to correct the decree because the matter is now before the Court of Appeal. The court held that once an appeal has been filed, the subject matter of the appeal, including the decree, falls under the jurisdiction of the appellate court. Therefore, the High Court lacks authority to make corrections to a decree that is actively contested on appeal. The application to correct the decree was thus not allowed.
Court Disposition
application dismissed
Orders
- Application to correct the decree is not allowed.

REPUBLIC OF KENYA IN THE HIGH COURT OF KENYA AT EMBU
Civil Case 107 of 2005
DAVID WACHIRA WAMBUGU………………….…….PLAINTIFF
VERSUS
CO-OPERATIVE INSURANCE CO. LTD……..…….DEFENDANT
RULING
I have perused the arguments by both counsel, Respondent argues that an appeal has already been filed and the issue raised by plaintiff is one contested in appeal.
I therefore find no reason to correct the decree which is now subject of an Appeal in Court of Appeal. Application not allowed.
Dated this 25th April, 2008.
