The court found that while there was a genuine case of redundancy due to restructuring and loss of donor funding, the Respondent failed to comply with the mandatory procedural requirements under Section 40(1) of the Employment Act. Specifically, the Respondent did not issue the required redundancy notice to the Claimant or the Labour Officer prior to termination. The absence of these notices rendered the redundancy process unprocedural and therefore unfair, notwithstanding the genuineness of the redundancy itself.
