Given the contradictory affidavit evidence and the inability to conclusively determine ownership at the interlocutory stage, the court held that the Plaintiff/Applicant failed to establish a prima facie case with a probability of success. As the first condition for granting a temporary injunction was not met, the court was not required to consider the other conditions (irreparable injury and balance of convenience). Accordingly, the application for a temporary injunction was dismissed.
