The court found that the 1st and 3rd defendants, who purported to sell the suit properties to the plaintiff, had no legal capacity or authority to do so as they were not administrators of the estate of the late Hezekiah Nelson Oyugi and the succession cause was still pending. The certificate of grant presented was found to be fake, and there was no court authority for the sale. The transaction was therefore void ab initio for want of capacity, amounting to intermeddling with the estate. However, the plaintiff, having paid Kshs 20,000,000 in good faith and taken possession, is entitled to a refund of the purchase price from the 1st and 3rd defendants, who received the money.
