The respondent, as a pillion passenger, could not have contributed to the accident, and any alleged failure to wear a helmet or reflective jacket was irrelevant to causation. On quantum, the appellate court held that the trial court's award of Kshs. 5,000,000 as general damages was excessive and unsupported by comparable authorities.
