Civil Appeal / Ruling on Application for Extension of Time and Stay of Proceedings
Legal Issues
- 1 Whether the applicant should be granted extension of time to file and serve a Notice of Appeal out of time.
- 2 Whether the court should stay proceedings in CMCC No 704 of 2018 pending appeal.
- 3 Whether the applicant's replying affidavit should be deemed as duly filed and served.
Ratio Decidendi
The court found that the delay in filing the Notice of Appeal was not inordinate and was excusable, as it was occasioned by the applicant's previous advocates failing to notify him of the lower court's ruling. The court exercised its discretion to extend the period for filing the Notice of Appeal, deeming the Notice of Appeal as properly filed upon payment of requisite court fees. The court further directed the applicant to file and serve the intended appeal documents within 30 days. The application was unopposed, and the court found no reason to deny the orders sought regarding extension of time. However, the court did not expressly grant all other prayers sought in the application,...

Orders
- The period to file notice of appeal is extended.
- Notice of Appeal dated May 22, 2023 and filed on May 23, 2023 is deemed as properly filed upon payment of the requisite court filing fees.
