The court found that the firm of Mbugwa, Atudo & Macharia Advocates acted without authority for Purple Saturn, and all pleadings and documents filed by them on behalf of Purple Saturn must be struck out. The amended plaint filed pursuant to the order of 10th May 2017 was also struck out, but the original plaint stands. On the issue of abatement, the court held that while Purple Saturn was not served with summons, there was no evidence as to when the summons were collected for service, and thus abatement could not be established. Regarding privity of contract, the court acknowledged that Purple Saturn was not a party to the Share Purchase Agreement but held that exceptions to the privity...
