Ratio Decidendi

The court found that there was no order from the Court of Appeal staying execution of its judgment. Therefore, the Plaintiffs were entitled to seek execution of the judgment, including the signing and execution of documents necessary for the subdivision and transfer of the land. The Defendant's pending appeal did not, in itself, operate as a stay of execution. The court held that in the absence of a stay, the successful party is entitled to the fruits of the judgment, and any prejudice to the Defendant could be remedied by the appellate court if the appeal succeeds. Accordingly, the application was allowed to facilitate the enforcement of the judgment for specific performance.
