The High Court determined that it lacks jurisdiction to hear and determine the appeal because the primary dispute concerns ownership, occupation, and title to land, matters which fall within the exclusive jurisdiction of the Environment and Land Court as established under Article 162(2)(b) of the Constitution and the Environment and Land Court Act, 2011. Although the appeal was filed shortly after the operationalization of the Environment and Land Court, the transitional provisions no longer apply, and jurisdiction is expressly ousted from the High Court.
