Ratio Decidendi

The court found that the trial court correctly awarded one month’s salary arrears for February 2021, as the Appellant failed to prove payment. However, the award of service pay was set aside because the Respondent was a member of NSSF and subject to the CBA, both of which excluded entitlement to service pay in these circumstances. The award for unpaid leave was reduced from 10 years to three years, as the Employment Act limits such claims to the three years preceding the suit. The court upheld the award of costs and interest at the lower court, finding no basis to interfere with the trial court’s discretion, but ordered that each party bear their own costs for the appeal.
