Procedural Posture

Notice of Motion / Interlocutory Application for Mandatory Injunction and Eviction Order

  1. 1 Whether the plaintiff is entitled to an interlocutory mandatory injunction and eviction order against the defendant in respect of Plot No. 67 Group No. 1 Takaungu.
  2. 2 Whether special or exceptional circumstances exist to warrant the grant of a mandatory injunction at the interlocutory stage.
  3. 3 Whether the defendant's continued occupation constitutes trespass and if the balance of convenience favours the plaintiff.

Ratio Decidendi

The court found that the plaintiff failed to demonstrate special or exceptional circumstances necessary for the grant of a mandatory injunction at the interlocutory stage. The dispute was not clear-cut, as the defendant and his family had been in occupation for decades, had previously litigated over the land, and had even been awarded portions by the Land Disputes Tribunal. The plaintiff acquired the property with knowledge of the defendant's occupation and ongoing disputes. The court held that the drastic orders sought could not be granted before the substantive dispute was heard and determined, as the circumstances did not meet the high threshold for interlocutory mandatory injunctions.
