The Tribunal found that the party's IDRM complied with the requirements of the Fair Administrative Action Act by notifying the claimant of the hearing and providing him an opportunity to be heard. The IDRM's judgment indicated that the claimant was informed of the hearing, appeared in person, but chose not to participate or file a response. The Tribunal was not convinced by the claimant's denial of attendance, especially as this aspect of the IDRM judgment was not challenged in his pleadings. Consequently, the Tribunal held that the claimant was not denied a fair hearing and could not claim otherwise in good faith. The complaint was therefore dismissed and the IDRM's decision upheld.
