Ratio Decidendi

The court found that its jurisdiction on reference is limited to reviewing the process and materials that were before the Taxing Master. The applicant failed to provide the original record or certified proceedings from the subordinate court, making it impossible to confirm or contest the taxed amount. The Taxing Master applied the correct schedule (Schedule 7) of the Advocates Remuneration Order, as the proceedings were in the subordinate court. The respondent.s submissions were filed out of time and were not properly before the Taxing Master, and the court could not consider them. In the absence of a complete record, there was no legal basis to interfere with the Taxing Master.s ruling....
