Ratio Decidendi

The Court of Appeal found that, due to the disappearance of both the trial court's judgment and the summing-up notes to the assessors, there was no record upon which the appeal could be determined. All parties agreed that a retrial was the only viable solution. The court therefore allowed the appeal, set aside the conviction and sentence, and ordered a retrial to be conducted as a matter of priority. The court further directed that, since the institution of assessors had been abolished, the retrial need not involve assessors.
