Ratio Decidendi

The presiding judge determined that, having previously confirmed the grant of letters of administration in the underlying succession cause that forms the basis of the present appeal, it would not be in the best interests of justice or in accordance with the constitutional right to a fair hearing for him to continue presiding over the matter. To avoid any appearance of bias and to uphold the integrity of the judicial process, the judge recused himself and ordered the transfer of the appeal, together with the relevant succession cause record, to the Migori Environment and Land Court for further orders and determination.
