The court found that the Respondent failed to comply with statutory requirements for fair termination under section 41 of the Employment Act, 2007, as no notice or hearing was given to the Claimant prior to termination on medical grounds. The Respondent also failed to prove that notice pay was given or paid in lieu thereof. The Claimant was underpaid in contravention of the prescribed minimum wage. Claims for responsibility allowance, overtime, rest days, annual leave, and breach of contract damages were not proved or were not legally sustainable. The Claimant was therefore entitled to one month’s pay in lieu of notice, compensation for unfair termination equivalent to seven months’...
