The applicant was not in possession of the suit premises and did not provide evidence of irreparable loss. However, in the interest of justice and to preserve the right of appeal, the court exercised its discretion to grant a conditional stay of execution. The conditions imposed included the deposit of all rents from the suit premises into court from December 2019 until the appeal is determined, the respondent's liberty to levy distress in case of default by tenants, and the refund of Kshs.266,900 in costs to the respondent...
