Ratio Decidendi

The court found that the plaintiff executed the decree before taxation of costs without obtaining leave of the court, as required by Section 94 of the Civil Procedure Act. The purported application to the deputy registrar was insufficient, as only a judge can grant such dispensation. The warrants of attachment and sale were therefore issued irregularly and without authority. The court allowed the defendant's application to recall and cancel the warrants, set aside any orders issued pursuant to them, and ordered the plaintiff to pay the auctioneer's costs and the costs of the application to the defendant.
