Procedural Posture

Civil Appeal / Ruling on Application for Consolidation and Stay of Execution Pending Appeal

  1. 1 Whether the appeal should be consolidated with Malindi HCCA No. 50 of 2021 and Malindi HCCA No. 51 of 2021.
  2. 2 Whether the appellant has met the threshold for granting an order for stay of execution of the garnishee order absolute dated 13/5/2020.

Ratio Decidendi

The court found that the appeals sought to be consolidated had already been determined and were no longer pending, rendering the court functus officio and without jurisdiction to consolidate them. Regarding the stay of execution, the court held that the appellant failed to demonstrate substantial loss or offer security as required under Order 42 rule 6 of the Civil Procedure Rules. The application for stay was also filed with unreasonable and unexplained delay. Consequently, the appellant did not meet the threshold for the grant of stay of execution pending appeal. The application was therefore dismissed with costs to the respondent.
