Ratio Decidendi

The court found that the application for stay of execution was moot because the applicant had already complied with the Garnishee Order Absolute and the judgment sum had been released to the estate. There was therefore nothing left to stay. Regarding the prayers for supervisory intervention over the missing court file, the court held that such administrative issues should be addressed through the judiciary's internal administrative channels rather than by judicial orders, as issuing such orders would be futile and unenforceable. The court emphasized that it should not make orders in vain or expose itself to ridicule. Consequently, the application was struck out for lack of merit.
