Ratio Decidendi

The High Court lacks jurisdiction to grant leave to appeal against the Magistrate's Court ruling where the applicant failed to first seek such leave from the court that made the order, as required by Order 43 rule 3 of the Civil Procedure Rules. The procedure for seeking leave is mandatory and must be strictly followed. The applicant's failure to approach the Magistrate's Court within the prescribed time frame is fatal to its application. As a result, the application for leave to appeal and for stay of execution is incompetent and must be struck out. Costs are awarded to the 2nd respondent.
