Ratio Decidendi

The appellant was properly convicted on his own unequivocal plea of guilty after the charges and facts were read to him in a language he understood and he admitted them. There was no procedural irregularity or miscarriage of justice in the conviction. As for sentence, the court considered the value of the stolen items (about KES 8,000) and the fact that most were recovered. The appellate court found the original sentence to be slightly harsh and exercised its discretion to reduce the sentence to three years' imprisonment on each count, to run concurrently. The appeal therefore succeeded only to the extent of sentence reduction, not on conviction.
