Ratio Decidendi

The court held that it lacked jurisdiction to entertain the appeal because the Embu Provincial Appeals Committee had not rendered a decision. Section 8(8)-(10) of the Land Disputes Tribunals Act makes it clear that appeals to the court can only arise from decisions of the Appeals Committee. Since no such decision existed, there was no valid appeal before the court. Entertaining the matter would be tantamount to acting without jurisdiction, which is impermissible. The court emphasized that jurisdiction is foundational and must be established before any proceedings can continue.
