Ratio Decidendi

The court held that while the Land Disputes Tribunal had jurisdiction to entertain claims relating to the right to occupy and work land, it exceeded its mandate by ordering the sub-division and transfer of registered land. The Tribunal's powers under the Land Disputes Tribunals Act No. 18 of 1990 did not extend to determining issues of title or effecting transfers of registered land. The Appeals Committee erred in upholding the Tribunal's decision, and the orders for sub-division and transfer, as well as all consequential orders, were set aside. The parties were advised to seek determination of their substantive rights in a court with proper jurisdiction.
