The Court of Appeal held that the High Court's ruling of 19th January 2001 did not restrict the 1st respondent's statutory right of sale to public auction only, nor did it require leave of court for a sale by private treaty. The reference to compliance with the Auctioneers Act was relevant only if the sale was by public auction, which was the threatened mode at the time of the application.
