Miscellaneous Application / Ruling on Application for Leave to Appeal Out of Time and Stay of Execution

  1. 1 Whether to extend time for filing of the appeal.
  2. 2 Whether to grant a stay of execution pending appeal.
  3. 3 Whether to accept the security offered by the applicants.

Ratio Decidendi

The court found that the applicants had explained the delay in filing the appeal and that the delay was not inordinate. Recognizing the right of appeal, the court exercised its discretion to extend the time for filing the appeal by 15 days from the date of the ruling. The court also determined that a stay of execution was reasonable given the circumstances, provided that the applicants furnished a bank guarantee of Kshs. 1 million valid for one year as security. The costs were ordered to abide the outcome of the appeal.

Court Disposition
